The National Defense Authorization Act authorizes the Secretary of Defense to transfer excess Department of Defense (DOD) personal property to federal, state, and local law enforcement agencies (LEAs) with special emphasis given to counter-drug and counter terrorism. In 1997, new guidelines were instituted allowing all LEAs to obtain property for a bona fide law enforcement need. The 1033 Program (formerly the 1208 Program) allows LEAs to receive DOD excess property. The 1033 Program has allowed law enforcement agencies to acquire vehicles aircraft and watercraft, weapons, computer equipment, fingerprint equipment, night vision equipment, radios and televisions, first aid equipment, tents and sleeping bags, photographic equipment, and more. The Governor of New York has designated a State Coordinator (SC) within the Division of Criminal Justice Services (DCJS), to provide administrative oversight and management of the 1033 Program. Within DCJS, the SC and the designated State Point of Contact(s) (SPOC) have operational authority to ensure that all participants comply with applicable Federal and State laws, directives, and policies for participation in the Program.
