DNA Owes Banner

The computerized criminal history (CCH) "rapsheet" currently displays two distinct banners for offenders convicted and sentenced for any felony defined in the Penal Law, or an attempt thereof where the attempt is a felony, as well as persons convicted and sentenced for specified misdemeanor offenses who are required to submit a DNA specimen for inclusion in the NYS DNA Databank.

The banners will indicate that an offender is required to provide a DNA specimen for the State DNA Databank and has not yet done so, or that a profile is on file in the DNA Databank.

If a specimen has not yet been collected a banner will read,"DNA SAMPLE OWED" Required to provide a DNA sample, suitable for testing, for inclusion in the New York State DNA Databank. If additional DNA Databank information is required call DCJS Office of Forensic Services at (518)457-1901. (Example) This message alerts criminal justice agencies to arrange for collection of a DNA specimen when a DNA-designated offender is under agency custody and/or control. The DNA specimen must be collected using the DNA collection kit provided by DCJS. Local collections of DNA specimens for the State DNA Databank are routinely performed at jail facilities, county probation offices and police departments, prisons and Parole. In some jurisdictions, these collections are also performed by Office of Court Administration court officers, clerks and Bailiffs.

When a DNA specimen has been collected AND analyzed the rap sheet will read “DNA PROFILE IS ON FILE IN THE DNA DATABANKIf more information is required, call DCJS Office of Forensic Services at (518) 457-1901. (Example) When this notice appears on the rap sheet it indicates that the offender’s DNA sample has been actually analyzed and loaded to CODIS. It should be understood that although the sample has been analyzed and added to CODIS that DNA profile searches occur on a continuous two week schedule and there could be up to a two week delay from the time a sample gets loaded into CODIS until the scheduled profile search is done.
